Terms of Use
1. General
1.1. These Terms of Use between the Government Technology Agency (“GovTech”) and you govern your access to and use of our services or any information or content (including APIs, if any) provided through https://www.scamshield.gov.sg/ or otherwise described in the Schedule, and all other accompanying features as identified in the Schedule below (collectively, the “Service”).
1.2. This Service is provided to you by GovTech, in collaboration with the Singapore Police Force (“SPF”) and the National Crime Prevention Council (“NCPC”). If you have any questions about these Terms, the Service or the Content, please contact us at -

1.3. By accessing or using any part of this Service, you unconditionally agree and accept to be legally bound by these Terms of Use and any amendments thereto from time to time. GovTech reserves the right to amend or supplement these Terms of Use at its sole discretion and at any time, with or without notice to you. Please read the Terms of Use carefully each time you access or use any part of this Service as (without prejudice to any other means your agreement to the Terms of Use as amended may manifest) such access or use shall constitute your agreement to the Terms of Use and any amendments or supplements to it. Your failure to do so shall not prejudice the effect or enforceability of the Terms of Use or any amendments thereto. GovTech may, at its sole discretion and without prejudice to its other rights under this Clause 1.3, also amend or supplement any part of the Service and/or these Terms of Use by providing you with notice effective immediately or such other time designated by GovTech, and such notice may be provided in accordance with Clause 20.
1.4. If you do not agree to these Terms of Use, please do not use this. If you do not agree to any amended Terms of Use, please cease use of this Service.
1.5. If you are accessing or using the Service for and on behalf of another entity (such as your employer), you warrant and represent that you have the necessary authority to bind such entity to these Terms of Use.
1.6. Nothing herein shall be construed as creating any contract between the SPF and/or the NCPC and you, in respect of the Service.
2. Nature of this Service
Please see the Schedule for more information and terms concerning this Service. You agree to abide and be bound by the terms set out in the Schedule.
3. Licence Terms and Restrictions
3.1. The Service, including the materials made available on or through the Service, is owned by, licensed to, managed or controlled by GovTech, the SPF and/or the NCPC.
3.2. Subject to these Terms of Use, GovTech grants to you a non-exclusive, revocable, and non-transferable right to access and use the Service for personal or internal purposes only, and only for such use permitted by the functions of the Service and intended by GovTech.
3.3. You shall not do or attempt to do, and shall not authorise or permit any third party to do, the following:
3.3.1 bypass or circumvent any technical restrictions or digital protection measures in the Service or secure areas of the Service and/or to any other protected information or attempt to circumvent any such restrictions;
3.3.2. reverse engineer, decompile, disassemble, modify, translate, adapt or create derivative works of the Service (whether in relation to its source code, object code, underlying structure, ideas, algorithms or otherwise);
3.3.3. reproduce, publish, distribute, transfer, publicly display, resell, rent, lease, scrape, compile or sublicense the Service, or loan, lend, pledge, assign, or otherwise encumber the Service to or in favour of any third party, or commercialise the Service and all information, functionalities, services or content, including but not limited to text, software, code, scripts, webpages, music, sound, photographs, video, graphics, graphical user interface, forms, diagrams or other content provided or otherwise made available through the Service (collectively, “Content”), including renting, selling, leasing, distributing or directly or indirectly charging others for use of the Service and/or Content;
3.3.4. remove, obscure or alter the copyright, trade mark and other proprietary notices contained on or in the Service, falsify or delete any author attributions, legal notices, or other labels of the origin or source of material, or otherwise represent the source or origin of the Service;
3.3.5. use the Service in any manner that is contrary to any applicable laws or regulations or rights of third parties (however arising and of whatever nature), or in a manner that constitutes harmful, fraudulent, or obscene activity;
3.3.6. make the Service available in or through a network, file-sharing service, service bureau or any similar timesharing arrangement or as a managed service provider;
3.3.7. perform any benchmarking tests or analysis of the Service;
3.3.8. use the Service to create anything that would compete with the Service;
3.3.9. transfer, assign or permit the sharing of license keys to or with a third party;
3.3.10. use the Service to process or permit to be processed any code of a third party;
3.3.11. provide third party access to the Service; or.
3.3.12. export the Service in violation of any international sanctions or laws applicable to US entities;
3.3.13. impersonate any person or to falsely state or otherwise misrepresent your affiliation with any person;
3.3.14. you shall not use in any way and shall not reproduce any trade mark, logo, trade name or similar mark that is associated with GovTech, the SPF, the NCPC or the Service, without our prior written consent, or that of a relevant third party;
3.3.15. you shall not attempt to gain unauthorised access to or otherwise interfere or disrupt other computer systems or networks connected to the Service through hacking, phishing, or other means;
3.3.16. interfere with another’s utilisation and enjoyment of the Service and/or the Content; and
3.3.17. in relation to any of our APIs, which may be accessible publicly or otherwise, you shall not attempt to or otherwise use, call on, integrate with, or download, such APIs without GovTech’s prior consent.
3.4. All express or implied rights to the Service not specifically granted herein are expressly reserved to GovTech.
3.5. GovTech reserves the right to:
3.5.1. Update, upgrade or modify this Service from time to time;
3.5.2. Deny or restrict access to or use of the Service by any particular person without ascribing any reasons whatsoever;
3.5.3. Discontinue, suspend or terminate this Service at any time without notice or liability to you whatsoever, whereupon all rights granted to you hereunder shall also terminate forthwith. You shall further upon notice from GovTech return or destroy all copies of the Service or materials therein that you may have been provided with.
3.6. You will not interfere or attempt to interfere with the proper operation of the Service or otherwise do anything that imposes an unreasonable or disproportionately large load on GovTech’s (or its service providers’) servers.
3.7. You shall comply with all set-up procedures and requirements, as well as all policies, guidelines, rules, notices and instructions relating to the Service as may be issued by and/or amended by GovTech from time to time.
4. Additional Terms
4.1. The Service may be used in combination with other websites, software or services and you may need to accept additional terms from us or other Third Parties (collectively, “Additional Terms” and these shall be deemed to include the terms set out in Paragraph 3 of Schedule 1) that will bind you. In order for you to:
(a) access certain information provided as part of the Service and made available through third party websites, applications or platforms, you may need to accept Additional Terms which are to be entered into between you and the relevant third party (in particular, those listed in Paragraph 3.1 of Schedule 1); and
(b) use the Service through the ScamShield app, we are obliged to notify you of certain Additional Terms and you will need to acknowledge and agree to such terms and / or notice (in particular, those listed in Paragraph 3.2 of Schedule 1).
4.2. It is your responsibility to check, read and accept the most up-to-date versions of these Additional Terms. In particular, you are deemed to have notice of any terms that we are to notify you of, and you shall accept and agree to be bound by all the obligations in the Additional Terms which are applicable to you as the end user, at the relevant time prior to accessing and using Service and the Content (or part thereof). If you breach or do not accept any Additional Terms, your use of the Service and the Content may be affected. For the avoidance of doubt, the Additional Terms which you have entered into with a Third Party are solely between you and such Third Party.
4.3. Disclaimers
4.3.1. You will not hold GovTech, the SPF and the NCPC liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of any Third Party’s service, website, webpage, software, application, online or electronic platform, including any damage or loss suffered as a result of reliance on the contents contained in or available from such Third Party’s service, website, webpage, software, application, online or electronic platform.
4.3.2. Nothing in the Service will be considered an endorsement, representation or warranty of or by GovTech with respect to any Third Party or any Third Party’s content, products, services, functionalities or otherwise. GovTech, the SPF and the NCPC make no representation or guarantee regarding the availability or content (including its truthfulness, accuracy, completeness, timeliness or reliability) of such Third Party content, product, service, functionality or otherwise and any use or reliance on the same by you is solely at your own risk.
4.3.3. Without prejudice to the generality of this Clause 4.3, you acknowledge that GovTech, the SPF and the NCPC:
(a) do not maintain or control, or have visibility over any transaction or activity conducted under a Third Party’s service, website, webpage, software, application, online or electronic platform;
(b) are not responsible for, and do not have control over, how any Third Party collects, uses, discloses, secures, protects, retains, stores, transfers or otherwise processes or deals with any data or personal data you share with such Third Party; and
(c) are not liable for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity, inaccuracy or any other objectionable material contained in the contents, or the consequences of accessing, any Third Party’s service, website, webpage, software, application, online or electronic platform.
4.4. Where you obtain a copy of the ScamShield app through (a) the official Apple App Store accessible at https://www.apple.com/sg/ios/app-store or such other successor site; or (b) the official Google Play accessible at https://play.google.comor such other successor site (each, an “Approved Online Store”), the additional terms set out in the Annex would apply to you.
5. Your Consent to Your Data and to Access Functions of Your Device
5.1. You hereby grant to GovTech a non-exclusive, worldwide, perpetual, irrevocable and royalty-free right to collect, use, disclose, process, modify, adapt, create derivative works of, reproduce, and sublicense any and all information, data or content submitted, uploaded or shared by you to the extent necessary to provide the Service or for any other purpose expressly or impliedly provided in these Terms of Use, or as permitted by law.
5.2. You further irrevocably and unconditionally waive, and shall cause to be irrevocably and unconditionally waived, all existing and future moral rights (including the right of identification) wherever in the world in respect of any information or data submitted, uploaded or shared by you (including feedback, requests or suggestions concerning the Services) to GovTech. Such waiver shall also extend to GovTech’s licencees, assigns and successors-in-title.

5.4. Your Consent to Access Functions of Your Device
5.4.1. Use of the Service via your device may require you to allow access by the ScamShield app to certain functions of your device, or allow the collection of data from you in connection with the Service. The functions of your device which you may be asked to allow access to may include but are not limited to the device’s camera, network interfaces, push notifications, SMSes, caller ID and identification, and contact list. Your use of the Service shall constitute your consent to the access by the Service of such functions of your device as may be reasonably required by the Service.
5.4.2. You may not be able to use certain functionalities of the Service (in particular, functionalities of the ScamShield app) if you do not comply with the requirements set out in Clause 5.4.1. For instance, you will need to grant the ScamShield app permission to access your message inbox for the SMS filtering functionality to work.
6. Feedback / Reports / Suggestions
6.1. You may generate, share, submit or transmit certain Content (including data or personal data relating to you, or that may relate to a third party individual and that is provided by you) when you submit feedback to GovTech or submit scam reports (“Generated Content”). Please ensure that your Generated Content is correct, true or appropriate for the purpose you are submitting your Generated Content.
6.2. Your Generated Content must not be of any type that:
(a) is false, offensive, defamatory, misleading, fraudulent; or
(b) contravenes any applicable laws, guidelines or violates the rights
of any person.
6.3. If you generate, share, submit or transmit Generated Content to GovTech, you acknowledge and agree that GovTech, the SPF, the NHPC, any other Public Agency and any other relevant third party may collect, use, disclose, modify, delete and process your Generated Content (including data and personal data relating to you, or that may relate to a third party individual and is provided by you) for the purposes of:
(a) processing or following up on your scam report;
(b) processing or following up on your scam report;
(c) processing or following up on your feedback; and/or
(d) sending you notifications about updates on your scam reports, and
any purposes directly incidental or related to the above.
Where any of the Generated Content you provide to GovTech contains data or personal data, GovTech will collect, use, store, disclose or process such data or personal data in accordance with our Privacy Statement.
6.4. Police reports: You acknowledge and agree that reports submitted over the Service are not police reports and GovTech is not responsible for and have no control over the making of such police reports. In the event that you encounter or have fallen for any scam, please file a police report with the SPF at https://eservices1.police.gov.sg/phub/eservices/landingpage/police-report.
7. Confidentiality
7.1 If you receive any Confidential Information, you shall not use, disclose or reproduce the Confidential Information except for the purpose for which it was provided to you. If consent to disclose the Confidential Information to a Third Party is given by GovTech, or the Third Party disclosing such Confidential Information, to you, any act or omission in respect of the Confidential Information by that person shall be deemed to be your act or omission and you agree to be fully liable for the same. In all cases, you shall protect the Confidential Information to the same extent you protect your own confidential information but in no event less than a reasonable standard of care. You shall ensure that any recipients are bound by confidentiality terms at least as restrictive as this clause.
7.2 You shall destroy any Confidential Information immediately upon request by GovTech or the Third Party who has disclosed the Confidential Information.
7.3 In the event:
7.3.1 you are, or likely to be, required by an order of court to disclose Confidential Information; or
7.3.2 you have reasonable grounds to suspect the unauthorised use or disclosure or reproduction of Confidential Information;
you shall immediately notify GovTech or the Third Party who has disclosed such Confidential Information of the same and cooperate with GovTech or the Third Party to prevent or limit such disclosure.
7.4 Nothing in this Clause 7 shall prejudice GovTech’s or the Third Party’s other rights under law.
8. Disclaimers and Indemnity
8.1. We may include hyperlinks to other websites or content on the Internet, and we are not liable for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity, inaccuracy or any other objectionable material contained in the contents, or the consequences of accessing, any linked website. Any hyperlinks to any other websites or content are not an endorsement or verification of such websites or content. Please note that your access to or use of such linked websites or content shall be at your own risk.
8.2 The Service is provided on an “as is” and “as available” basis without warranties of any kind. No representations or warranties of any kind, express, implied and/or statutory, are given in conjunction with the Service and Content by GovTech, the SPF and the NCPC to you or any third party, including any representations or warranties:
8.2.1. as to the accuracy, completeness, correctness, currency, timeliness, reliability, availability, interoperability, security, non-infringement of Third Party rights, title, merchantability, quality or fitness for any particular purpose of the Service or its output and the Content; and/or
8.2.2. that the Service or its output or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that the Service, its output, the Content, website and the server are and will be free of all viruses and/or other malicious, destructive or corrupting code, programme or macro.
8.3. GovTech, the SPF and the NCPC shall also not be liable to you or any third party for any damage or loss of any kind whatsoever and howsoever caused, including but not limited to any direct or indirect, special or consequential damages, loss of income, revenue or profits, lost or damaged data, or damage to your computer, software or any other property, whether or not arising directly or indirectly from –
8.3.1. your access to or use of the Service or its output or the Content, or any part thereof;
8.3.2. any loss of access or use of the Service, the Content or any part of the Service or its output or any part of the Content, howsoever caused;
8.3.3. any inaccuracy or incompleteness in, or errors or omissions in the transmission of, the Service or its output or the Content;
8.3.4. any delay or interruption in the transmission of the Service or its output or the Content, whether caused by delay or interruption in transmission over the internet or otherwise; or
8.3.5. any decision made or action taken by you or any third party in upon the Service or its output or the Content,
regardless of whether GovTech, the SPF and/or the NCPC has been advised of the possibility of such damage or loss.
8.4. Without prejudice and in addition to the foregoing, insofar as the Service facilitates or requires the provision, use or functioning of, or is provided in conjunction with, other products, software, materials and/or services not provided by GovTech, GovTech makes no representation or warranty in relation to such products, software, materials and/or services (including without limitation any representation or warranties as to timeliness, reliability, availability, interoperability, quality, fitness for purpose, non-infringement, suitability or accuracy).
8.5. You shall not rely on any part of the Service or its output or the Content, to claim or assert any form of legitimate expectation against GovTech, whether or not arising out of or in connection with GovTech’s roles and functions as a public authority. GovTech shall have no responsibility or liability to you or any third party arising out of or in connection with any fraud, phishing, or any other illegal act or omission by other parties in relation to the Service and it is your own responsibility to ensure that the Service you are using or accessing is from a legitimate source.
8.6. You unconditionally and irrevocable undertake to defend, indemnify and hold GovTech, the SPF, the NCPC and each of their officers, employees, agents and contractors harmless against all liabilities, losses, damages, costs or expenses (including legal costs on an indemnity basis) howsoever arising out of or in connection with your: (a) access or use of the Service (including third party software or services) or its output and/or the Content; (b) your non-compliance with the Terms of Use or Additional Terms; (c) any harm or damage caused by you to any Third Party; and/or (d) any contravention of any applicable laws, regulations or guidelines, whether or not you had been advised or informed of the nature or extent of such liabilities, losses, damages, costs or expenses. You warrant and represent that:
8.6.1. your access or use of the Service and its output does not and will not breach or violate any laws, regulations, trade, economic and/or export sanctions (wherever in the world) applicable to you; and
8.6.2. you shall not use or transmit, in any way, any software or material that contains, or which you have reason to suspect contains, viruses, damaging components, any malicious code or harmful components which may impair or corrupt the Service’s data or damage or interfere with the operation of the Service or another person’s computer or mobile device, and any illegal, infringing or undesirable content or materials to GovTech, the SPF and/or the NCPC or each of their agents or any Third Party.
8.7. GovTech shall have the right to take any and all necessary actions/omissions to protect its interests, including complying with any legal requirements (such as taking down, disabling and disabling access to, removing (permanently or temporarily), and/or restoring (including restoring access to) any materials contained in, accessed through, uploaded to, and/or made available via the Service in response to any take-down or restoration notices). You agree that GovTech is not obliged to determine the merits of any take-down or restoration notices. You further waive any rights arising as a result of the actions/omissions taken by GovTech.
8.8. Without prejudice and in addition to GovTech’s other rights:
8.8.1. in no event shall GovTech’s, the SPF’s and the NCPC’s total cumulative liability to you for any and all claims, suits, demands, actions or other legal proceedings under, arising out of or in connection with these Terms of Use, any Content or relating to or arising in connection with this Service whether based on an action or event or series of connected actions or events arising from the same factual act or omission, in contract, negligence, tort or otherwise, to you exceed the amount of fees or payment received by GovTech (and not paid or given to any Third Party by GovTech) from you for the Service in the 12 months preceding the date of the first cause of action; and
8.8.2. no action may be brought by you against GovTech [or providing agencies] arising out of or in connection with these Terms of Use, any Content or relating to or arising in connection with this Service, more than one (1) year after the cause of action arose.
9. Hyperlinks
9.1. Insofar as the Service provides hyperlinks to other websites or content on the Internet material which are not maintained or controlled by GovTech, GovTech shall not be responsible for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity, inaccuracy or any other objectionable material contained in the contents, or the consequences of accessing any hyperlinked website material and shall not be liable for any damages or loss arising from access to the hyperlinked material. Use of the hyperlinks and access to such hyperlinked materials are entirely at your own risk. The hyperlinks are provided merely as a convenience to you and do not imply endorsement by, association or affiliation with GovTech of the contents of or provider of the hyperlinked materials.
9.2. Caching and hyperlinking to, and the framing of, any part of the Service is prohibited save where you have obtained GovTech’s prior written consent. Such consent may be subject to any conditions as may be determined by GovTech in its sole discretion. If you hyperlink to or frame any part of the Service, that shall constitute your acceptance of these Terms of Use and all amendments thereto. If you do not accept these Terms of Use as may be amended from time to time, you must immediately discontinue linking to or framing of any part of the Service.
9.3. GovTech reserves all rights:
9.3.1. to disable any links to, or frames of, any materials which are unauthorised (including without limitation materials which imply endorsement by or association or affiliation with GovTech, materials containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, or information that violates any written law, any applicable intellectual property, proprietary, privacy or publicity rights); and
9.3.2. to disclaim responsibility and/or liability for materials that link to or frame any part of the Service.
10. Privacy Statement
You also agree to the terms of the ScamShield Privacy Statement for this Service (accessible at https://www.scamshield.gov.sg/privacy/) as may be amended from time to time. The ScamShield Privacy Statement will form part of these Terms of Use.
11. Termination
11.1. In GovTech’s sole and absolute discretion, it may with immediate effect, with or without notice, (i) discontinue or terminate the Service and/or the Content (or any part thereof), or (ii) deny or restrict your access to and use of the Service and/or the Content (or any part thereof), for any reason whatsoever (including a breach of any of these Terms of Use), whereupon these Terms of Use shall also terminate.
11.2. Upon termination of these Terms of Use for any reason all rights and/or licences granted to you under these shall immediately cease and terminate and you must immediately cease all access and use of the Service and the Content. Any termination of these Terms of Use for any reason shall not affect any of GovTech’s rights accrued prior to termination, and your obligations under any provisions of these Terms of Use which are meant to survive the termination.
12. Rights of Third Parties
12.1. Save for the SPF, the NCPC, any Public Agencies and Apple (in relation to the Annex), a person who is not a party to these Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act 2001 or otherwise to enforce any of its terms.
12.2. Notwithstanding Clause 12.1 and without prejudice to Clause 1.3, GovTech’s right to vary these any part of this Service and the Terms of Use in the manner aforesaid shall not require the consent of any third party, including the SPF, the NCPC and/or any Public Agency.
13. Assignment and Sub-contracting
13.1. You must not assign or sub-contract these Terms of Use without the prior written consent of GovTech.
13.2. GovTech may assign, novate, transfer, or sub-contract the rights and liabilities in respect of the Service and these Terms of Use, without notifying you and without further reference to you. Your acceptance of these Terms of Use shall also constitute your consent to such assignment, novation, transfer or sub-contract.
14. Severability
If any term of these Terms of Use is held by a court or tribunal of competent jurisdiction to be invalid or unenforceable, then these Terms of Use, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included but, to the extent permissible, such invalid or unenforceable terms shall be deemed to have been replaced by terms that are (a) valid and enforceable and (b) express the intention or produce the result closest to the original intention of the invalid or unenforceable terms.
15. Order of Precedence
In the event of any conflict, inconsistency or ambiguity between or in any one or more terms in these Terms of Use, such conflict, inconsistency or ambiguity shall be resolved in favour of GovTech and the provision or interpretation which is more favourable to GovTech shall prevail.
16. Entire Agreement
These Terms of Use contains the entire and whole agreement concerning the subject matter of these Terms of Use. The Terms of Use supersedes all prior written or oral representations, agreements and/or understandings between GovTech and yourself.
17. Waiver
17.1. Any delay, failure or omission on the part of GovTech in enforcing any right, power, privilege, claim or remedy (“Remedy”), which is conferred under the Terms of Use or at law or in equity, or arises from any breach by you, shall not (a) be deemed to be or be construed as a waiver or variation of the Remedy, or of any other such Remedy, in respect of the particular circumstances in question, or (b) operate so as to bar the enforcement or exercise of the Remedy, or of any other such Remedy in any other subsequent instances.
17.2. No waiver by GovTech of any breach of the Terms of Use by you shall be deemed to be a waiver of any other or of any subsequent breach.
17.3. Any waiver by GovTech granted under the Terms of Use must be in writing and may be given subject to conditions. Such waiver under the Terms of Use shall be effective only in the instance and for the purpose for which it is given.
18. Force Majeure
GovTech shall not be liable for non-performance, error, interruption or delay in the performance of its obligations under these Terms of Use (or any part thereof) or for any inaccuracy, unreliability or unsuitability of the Service if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond GovTech’s reasonable control.
19. Binding and conclusive
You acknowledge and agree that any records maintained by GovTech or its service providers relating to or in connection with the Service shall be binding and conclusive on you for all purposes whatsoever and shall be conclusive evidence of any information and/or data transmitted between GovTech and you. You hereby agree that all such records are admissible in evidence and that you shall not challenge or dispute the admissibility, reliability, accuracy or the authenticity of such records merely on the basis that such records are in electronic form or are the output of a computer system, and you hereby waive any of your rights, if any, to so object.
20. Notice
Notice to you may be provided by any means GovTech deems appropriate (for example, by posting the notice through the Service, any website related to the Service, or by email).
21. Governing Law and Dispute Resolution
21.1. Governing Law: These Terms of Use, any Content or relating to or arising in connection with this Service or any related services, software, data or other materials provided by GovTech shall be governed by and construed in accordance with the laws of the Republic of Singapore.
21.2. Dispute Resolution
21.2.1. Subject to Clause 21.2.2, any dispute arising out of or in connection with these Terms of Use, any Content or relating to or arising in connection with this Service or any related services, software, data or other materials provided by GovTech, including any question regarding the existence, validity or termination of these Terms of Use, shall be finally resolved by reference to the Courts of the Republic of Singapore and the parties submit to the exclusive jurisdiction of the Courts of the Republic of Singapore, subject to GovTech having the option of electing to refer the dispute to arbitration.
21.2.2. Where GovTech is a defendant or respondent, it shall be given notice by the complainant before the commencement of any legal action against GovTech to enable it to elect to have the dispute submitted to arbitration. GovTech may, at its sole discretion, elect to have any dispute referred to in Clause 21.2.1 above referred to arbitration by written notice to the participant(s) involved and shall make the election within thirty (30) days of receipt of the complainant’s written notice. The complainant’s written notice shall:
(a) state the specific dispute, difference, or claim to be resolved and
the nature of such dispute, difference, or claim; and
(b) include a request that GovTech make an election whether the dispute,
difference, or claim as stated shall be resolved by reference to arbitration
or by court proceedings.
21.2.3. Should GovTech fail to make the election to have the dispute referred to arbitration within thirty (30) days of the receipt of the written notice, the dispute, difference or claim shall be resolved by the Courts of the Republic of Singapore. GovTech may elect to refer to arbitration all or any part of the dispute or difference as stated by the complainant in its written notice. This right to elect shall not prejudice GovTech’s right to a limitation defence and the period to exercise the right shall not be abridged by reason of any accrual of a limitation defence in GovTech’s favour during the said period.
21.2.4. Where the dispute is referred to arbitration by GovTech, it shall be administered by the Singapore International Arbitration Centre (“SIAC”) in Singapore in accordance with the Arbitration Rules of the SIAC (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this Clause. Further:
(a) the seat of the arbitration shall be Singapore;
(b) the tribunal shall consist of one (1) arbitrator to be agreed upon
in accordance with the SIAC Rules, save that if no agreement is reached
within thirty (30) days after receipt by one party of such a proposal from
the other, the arbitrator shall be appointed by the Chairman of the SIAC;
(c) the language of the arbitration shall be English; and
(d) all information, pleadings, documents, evidence and all matters relating
to the arbitration shall be confidential.
21.2.5. Notwithstanding any provision of this Clause 21.2, each Party shall be entitled to seek, before or during any arbitral proceeding, interlocutory, provisional or interim relief or remedies from any court including being entitled to seek an interim measure or protection in aid of arbitration or the subject matter of arbitration.
21.2.6. Any reference to arbitration under this Clause 21.2 shall be a submission to arbitration within the meaning of the Arbitration Act 2001 for the time being in force. The application of Part II of the International Arbitration Act 1994, and the Model Law referred thereto, to this Agreement is hereby expressly excluded.
21.2.7. GovTech shall be entitled to discontinue or suspend provision of any part of the Terms of Use, any Content or relating to or arising in connection with this Service or any related services, software, data or other materials provided by GovTech and its performance under these Terms of Use until such dispute is settled or resolved in accordance to this Clause 21.2.
22. Interpretation
22.1. In these Terms, unless otherwise defined or unless the context otherwise suggests, when the following words and phrases are used, they will have the following meanings:
22.1.1. “Alerts” means specific prompts in respect of scam and/or other Content that we may, but are not obliged to, provide.
22.1.2 “API” means any application programming interface, including any software code comprised therein and/or implementing the same.
22.1.3. “Confidential Information” means, in whatever form:
(a) all non-public information disclosed, furnished or made available
directly or indirectly by GovTech or a Third Party to the User in relation
to or in connection with the Service;
(b) all information, documents, drawings, manuals, materials, diskettes
and other storage media of GovTech or a Third Party stamped or marked as
“Confidential” or “restricted” or with other similar indicia and all other
information designated by GovTech or a Third Party as confidential either
verbally or in writing; and
(c) all copies and reproductions of all the types of information listed
in Clauses 22.1.3(a) and 22.1.3(b) and all communications between the Parties
relating to such information.
22.1.4. “Party” means either GovTech or User as the context requires, and references to “Parties” mean both GovTech and the User.
22.1.5. “Public Agency” means any of the following entities/parties:
(a) the Government of the Republic of Singapore;
(b) any ministry or organ of state within the Republic of Singapore;
(c) any department, commission, authority, agency or other body operated
by or accountable to a ministry or organ of state within the Republic of
Singapore;
(d) any organisation which was created, constituted or given rise to by
a statute enacted by the Parliament of the Republic of Singapore,
and “Public Agencies” means all of the aforementioned, but “Public Agency” and “Public Agencies” shall exclude GovTech, where it is acting in its capacity as the provider and operator of the Service.
22.1.6. “ScamShield app” means the mobile application, available on (i) the official Apple App Store accessible at https://www.apple.com/sg/ios/app-store/ or such other successor site; (ii) the official Google Play accessible at https://play.google.comor such other successor site; and (iii) such other websites as may be specified by us from time.
22.1.7. “ScamShield Helpline” means 1799 or any other hotline as may be specified by us from time to time.
22.1.8. “ScamShield Website” means https://www.scamshield.gov.sg/ or such other website as may be specified by us from time to time.
22.1.9. “Third Party” means a legal entity, company or person that is not a Party to these Terms.
22.1.10. “User”, “you” or “your” refers to any person who accesses or uses the Service.
22.2. Unless the contrary intention appears, in these Terms of Use:
22.2.1. reference to “Clauses” or “Clause” shall refer to the clauses or clause of these Terms of Use and shall include all sub-clauses of the respective clauses being referred to;
22.2.2. headings are inserted for convenience only and do not affect the interpretation of these Terms;
22.2.3. words importing the singular include the plural and vice versa;
22.2.4. references to persons are to be construed as references to an individual or a body corporate as the context requires;
22.2.5. the words, “include”, “includes”, and “including” are to be read as if they are followed by the phrase “without limitation”;
22.2.6. any reference to “Service” includes a reference to “part of the Service”; and
22.2.7. any reference to any Act of Parliament includes any amendment, replacement or re-enactment to that Act and includes any subsidiary legislation made under that Act.

1. Name of Service: ScamShield
2. Nature of Service:
2.1. Scope of the Service: The Service is designed to assist with the detection of potential scams as well as providing information on scams. Through the Service, you may:
(a) access a dedicated and free informational resource on scams;
(b) via the ScamShield app,
(i) check whether suspicious calls, websites and messages have been flagged
as scams;
(ii) filter and block calls you receive, if these are identified as potential
scam calls; and
(iii) filter SMSes you receive, if these are identified as potential scam
messages; and
(iv) receive push notifications about scam reports you have submitted
and scam trends; and
(c) via the ScamShield app or the ScamShield Helpline, report potential scams.
2.3 Access and use of the Service: This Service is available through the ScamShield app, the ScamShield Website, the ScamShield Helpline, or such mobile applications, websites, helplines, channels or platforms as may be designated by us from time to time.
2.4. Use of the ScamShield app: Aspects of the Service are only accessible through the ScamShield app.
(a) The free to use ScamShield app works actively in the background of your mobile device, to facilitate the detection, reporting and blocking of potential scam calls, as well as filtering potential scam SMSes from unsaved numbers not in your contact list. The application does not have access to known data that you do not choose to share. Further, the ScamShield App cannot access the contents of SMSes already in your inbox prior to installation of the ScamShield app, and it cannot access your call log.
The ScamShield app uses a Machine Learning algorithm to analyse incoming messages from unsaved senders. If the message is determined by the algorithm to be a potential scam message, then the potential scam message will be sent to the authorities for review. There is no personal data of the ScamShield app user that is being shared with the authorities, and the ScamShield app and the Service do not have any capability to track messages from individual users.
The ScamShield app enables users to submit screenshots, call logs and text for checks to verify if a call or message they have received is from a verified source. If the message or call is determined by the ScamShield app (via its algorithm) to be a potential scam, a check outcome will be provided to the user and the potential scam message/call will be sent to the authorities for review.
(b) Alerts: You may receive Alerts from time to time in relation to scams, including notifying you of the scam reports you submit through the ScamShield app and surges in certain scams. Each Alert may be notified by in-app notifications, mobile push notifications or any other method of notification as may be designated by us from time to time. We do not guarantee the delivery, timeliness or accuracy of Alerts. We reserve the right to vary any Alert and to terminate the provision of the Content in the Alerts at any time without giving any reason or prior notice. We shall not be liable to you or anyone else for losses, damages, fines or claims arising from:
(i) non-delivery, delayed delivery or wrong delivery of any Alert;
(ii) inaccurate Content of an Alert; or
(iii) use or reliance by you on the contents of any Alert for any purpose.
3. Third party software/services:
3.1 Pursuant to Clause 4.1(a), certain information provided as part of the Service may be made available through third party websites, applications or platforms, through these Additional Terms which are to be entered into between you and the relevant third party:
(a) in relation to your receipt of scam alerts via:
(i) Whatsapp: the “Terms of Service” at https://www.whatsapp.com/legal/terms-of-service;
(ii) Telegram: the “Terms of Service” at https://telegram.org/tos; and
(b) in relation to Content provided via the ScamShield Instagram page (at https://www.instagram.com/scamshieldsg/or such other successor site as we may determine from time to time): the “Terms of Use” at https://help.instagram.com/termsofuse.
3.2 Pursuant to Clause 4.1(b), the ScamShield app incorporates the following third party software / services, which are subject to the following Additional Terms:

4. Special terms
4.1. GovTech, SPF and NCPC are not liable for any errors, omissions or inaccuracy contained in the Content, or the consequences of accessing any such Content. You agree that we are not responsible for and have no control over the Content displayed or otherwise made available through the Service, including via the ScamShield Website. In the event of any inaccuracy or error in the Content (including conflicts or inconsistencies with communications published by any Public Agency), please contact feedback@scamshield.gov.sg for assistance.
4.2. We make no representation or guarantee regarding the ability (including the ability to detect, report and/or block scam calls and SMSes), availability or content (including its truthfulness, accuracy, completeness, timeliness or reliability) of the ScamShield app or otherwise and any use or reliance on the same by you is solely at your own risk.
ANNEX: DISTRIBUTION TERMS FOR SCAMSHIELD APP
1. You acknowledge and agree to the following additional terms, which are required by the provider of the relevant Approved Online Store, where you obtain the ScamShield app from such Approved Online Store:
1.1 if you downloaded the ScamShield app through the Apple App Store:
(a) Apple, Inc. (“Apple”) is not a party to these Terms of Use;
(b) Apple is not responsible for the ScamShield app or its content thereof; including (i) any maintenance and support services; (ii) any warranty obligation whatsoever; and (iii) addressing any claims (including any intellectual property infringement claim) from you or of any third party relating to the ScamShield app or your possession and/or use of the ScamShield app;
(c) you represent and warrant that (i) you are not located in a region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties; and
(d) Apple will have the right to enforce this paragraph 1.1 of this Annex against you as a third party beneficiary thereof.
